Using this site or placing an order means you accept these terms. If you do not accept them, do not order. Nothing here takes away rights the Consumer Protection Act gives you: where these terms and that Act disagree, the Act wins.

02 / What we sell

We sell two different kinds of thing, and they do not work the same way:

  • Our own carbon fibre parts, made by hand to order in our workshop. These are built when you order them.
  • Performance parts from other manufacturers, which we resell. These carry their maker's warranty, and the description, photographs and fitment information come from that maker.

Carbon fibre is laid by hand. Weave alignment, depth of finish and small cosmetic variation differ from one part to the next. That is how the material behaves and it is not a fault. If you want two parts to match closely, order them together and tell us.

03 / Orders

Placing an order is an offer to buy, not a completed sale. The sale is concluded when we accept the order, which we do by confirming it or by starting the build.

We may decline an order, and we will refund you in full if we do. Reasons include:

  • The item is out of stock or our supplier has discontinued it.
  • A price or description was obviously wrong. An obvious error stays an error even after you have paid, and we will not hold you to it either.
  • We cannot deliver to where you are.
  • We have reason to think the order is fraudulent.

04 / Prices & payment

All prices are in South African Rand. The price you see is the price you pay. We are not a registered VAT vendor, so no VAT is charged and none is added at checkout. Delivery is charged separately unless we have said otherwise.

Payment is taken by Peach Payments. You enter your card details on their system, not ours, and we never see or store them. We start work once payment has cleared.

Prices can change without notice, but never on an order we have already accepted. Imported parts are priced on the exchange rate at the time of listing; if a rate moves sharply before we accept your order, we will contact you rather than quietly change it.

05 / Lead times

A made-to-order carbon part normally takes about 6 weeks from cleared payment. The stages are on our home page and we are happy to send progress photographs while yours is being built.

Lead times are estimates given honestly, not guarantees. Imported parts depend on the supplier and on customs. If something is going to be materially late, we will tell you as soon as we know, and you can wait or cancel for a full refund.

06 / Delivery

We deliver across South Africa by courier and will give you a tracking number. It is your job to give us an address where somebody can receive the parcel; a redelivery caused by a wrong or unattended address is charged to you.

Risk passes to you when the parcel is delivered to the address you gave us. Check it on arrival. If it arrives damaged, tell us within 7 days, with photographs of the packaging as well as the part, because that is what a courier claim needs.

07 / Fitment is your responsibility

Check that a part fits your car before you order it. Our fitment lists are a guide taken from the manufacturer, and cars vary by year, market, trim and whatever a previous owner did to them.

If you are not certain, ask us first with your year, model and VIN. We would much rather answer a message than have you receive a part that will not bolt on.

A part that does not fit because it was ordered for the wrong car is a change of mind, not a fault, and is handled under cancelling below.

Fitting is your responsibility too. Performance parts should be fitted by a competent workshop. We do not cover the cost of fitting, removal, paint, alignment, tuning, or any other work done to your car, whether or not the part turns out to be faulty.

08 / Cancelling

For goods bought online, the Electronic Communications and Transactions Act gives you a 7 day cooling-off period after delivery, in which you can cancel without giving a reason. You pay the cost of returning the goods, and they must come back unused, unfitted and in their original packaging. We refund within 30 days.

The exception: made-to-order parts

That cooling-off right does not apply to goods made to your own specification. A carbon part built to your order, in a finish or specification you chose, is made for you and cannot simply be sent back because you changed your mind.

So tell us quickly. If you cancel before we have started laying the part, you get a full refund. Once the build has started we can only refund what we have not already spent on materials and labour, and we will show you that honestly. Once it is finished, we cannot refund a change of mind.

This has nothing to do with faults. A faulty part is covered below either way.

09 / Faults & returns

The Consumer Protection Act says goods must be of good quality, in working order and free of defects. If something we sold you is faulty, you have six months to return it, and you choose whether you want it repaired, replaced or refunded. That is your choice, not ours.

We will not treat as a fault:

  • Damage from an accident, misuse, or fitting the part incorrectly.
  • Normal wear, or the gradual fading and weathering of a finish left outdoors.
  • Cosmetic variation in hand-laid carbon, as described above.
  • Damage caused by modifying the part after you received it.

Parts from other manufacturers also carry that maker's own warranty, and we will help you claim under it.

To start a return, email sheldongovender6@gmail.com with your order number and photographs. Do not send anything back before we have replied, or we may not be able to trace it.

10 / Competition and off-road use

Some parts we sell are intended for competition or off-road use and may not be legal on a public road where you live. Roadworthiness and compliance are your responsibility, not ours, and you should check with your licensing authority and your insurer before fitting.

Modifying a car can affect its warranty and its insurance. Tell your insurer what you have fitted.

We do not warrant any part for motorsport, track day, or competition use. Those conditions are far beyond normal road use and no warranty here extends to them.

11 / Accounts & reviews

Keep your password to yourself; anything done from your account is treated as done by you. Tell us straight away if you think somebody else has got into it.

Reviews are read before they go up. We publish criticism, including reviews that are bad for us, because a review section that only contains praise is worth nothing. We will remove a review that is abusive, dishonest, about something other than the part, or that contains somebody's personal information. We do not write reviews ourselves and we do not pay for them.

12 / Our material

The photographs of our own parts and workshop, the wording on this site and the Gapped Performance name belong to us. Do not use them to sell things. Manufacturer photographs and descriptions of resold parts belong to those manufacturers.

You are welcome to share photographs of your own car with our parts on it, anywhere you like.

13 / Liability

We are responsible for the part we sell you. Our liability is limited to what you paid for it, which is the ordinary position for a parts supplier and the basis on which these prices are set.

We are not liable for indirect losses: lost track days, lost earnings, the cost of a hire car, or work done to your vehicle by somebody else.

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If any part of this section is unenforceable, the rest still stands.

14 / Governing law

These terms are governed by the law of South Africa and disputes go to the South African courts.

Talk to us first. Almost everything gets sorted out with a message. If it does not, the Consumer Goods and Services Ombud handles complaints against retailers for free, and you can go to them without our agreement.

15 / Changes

We may update these terms. The version that applies to your order is the one published when you placed it, so changing this page later cannot change a deal you have already made.
